Steps to take before beginning the divorce process

The pressures that come with work, family and finances can easily cause two spouses to drift apart. Over time, they may decide that getting divorced is the best option. Here are a couple of important steps to take before embarking on the path to divorce in Illinois.

Starting the divorce process off right

One of the most important steps to take during divorce proceedings is to get one’s finances organized. This includes determining what are the marital assets, which could include a house, financial accounts and motor vehicles. Artwork, inheritances and pension plans may also have to be taken into consideration. This will help both parties to know where they stand financially, which will help with the asset and debt distribution decision-making process.

It may make sense for divorcing individuals to open financial accounts in their separate names only. Then, they can each remove 50% of the money from their joint account and place the funds into their new individual accounts. This will help to prevent one party from raiding the joint financial account to the detriment of the other spouse.

How an attorney can help

It could also benefit an individual who plans to end his or her marriage to find appropriate legal support before moving forward. An experienced attorney can seek a just and comprehensive settlement that also protects the best interests of his or her client. An attorney will also be prepared to fight and work diligently for the client in court should any matters be contentious.
