Understanding emergency child support modifications

Child support is necessary to help many parents get by financially. But while child support payments tend to be stable from month to month, the cost of raising a child is often tumultuous. This is why many parents find that they need to ask for additional financial support when they encounter a difficult financial situation.

It is possible to request a temporary child support modification in an emergency situation. In order to do so, you will need to show that there has been or will be a change in circumstances that warrants the need for additional financial support.

What kind of change in circumstances will be considered acceptable for a temporary modification?

The courts will likely accept a change of circumstances that cannot be avoided and that will lead to financial hardships. This could be a parent or child’s medical emergency, a temporary loss of job, or a need for additional childcare for a certain amount of time.

Do I need to prove the change in circumstances?

You should be able to have documented evidence of this change of circumstances. For example, you may be able to show medical documents relating to an upcoming surgery, medical bills that you need to pay or additional childcare costs. You should also be able to give an accurate estimate of how long the change of circumstances will be in place.
